Title Slide: Dealing With Disagreement | With Ashley Renz, Brad Schweiger and Lane Fitzgerald
Attorney Brad Schweiger: How do I deal with a client that disagrees with me? The first thing is stay calm and be respectful. Usually if someone, especially a client, disagrees with you they have reasons that they disagree with you. A lot of times it comes from confusion as to something that’s maybe a hypertactical area of the law or they just don’t understand a process.
A lot of things can be resolved just by talking it over and telling them and explaining it to them why there is a disagreement and why maybe we think at least they may be a little but misguided on in any particular area. That usually goes a long way.
Attorney Ashley Renz: When a client disagrees with what I think is the better way to go, generally I’ll sit down with them and try and figure out what it is their goals are. What is it that they’re trying to accomplish?
Then I’ll explain to them what my position is and why my position is that. Then we’ll try to figure out a happy medium, something that the client is happy about but is still going to get the goals achieved that need to be.
Attorney Lane Fitzgerald: Well, the thing is, it’s perfectly okay for a client to disagree with any one of the attorneys here. Our job isn’t to make any decisions for you. Our job is to give you the potential benefits and the potential drawbacks to any decision that you might make regardless of whether it’s criminal or civil or something as simple as drafting a will or something as complex as family law or criminal litigation or even a bankruptcy proceeding.
Our job is to simply let you know what all the potential consequences and benefits are to any decision that you might make and then to kind of help you weigh those decisions in your decision making process. It’s not really our place to tell you what to think or what to do, it’s our place to help you make the best decision possible.
